A man died Monday after a large wave trapped him beneath debris on a California beach, likely related to the storm pummeling the West Coast that brought high surf and flooding to central California, officials said. First responders were called to Sunset State Beach, a state park, around 11:30 a.m. Monday. The man was pronounced dead at a hospital. Other details were not immediately available and his name has not been released. The storm’s high surf also likely pulled a man into the Pacific Ocean around noon Monday at Marina State Beach along the Monterey Bay, authorities said. Strong currents and high waves forced searchers to abandon their efforts roughly two hours later as conditions worsened. The man remained missing Monday evening. In Santa Cruz, a pier under construction partially collapsed and fell into the ocean, taking three people with it. Two people were rescued by lifeguards and a third swam to safety. No one was seriously injured, Mayor Fred Keeley said. Residents were warned to stay away from low-lying areas near the beaches around the Santa Cruz Wharf, about 70 miles (112 kilometres) south of San Francisco, as the storm rapidly gained strength. The mayor said that section of the wharf had been damaged over time. The structure was in the middle of a $4 million renovation following destructive storms last winter. “It’s a catastrophe for those down at the end of the wharf," said David Johnston, owner of Venture Quest Kayaking, who was allowed onto the pier to check on his business. Tony Elliot, the head of the Santa Cruz Parks & Recreation Department, estimated that about 150 feet (45 metres) of the end of the wharf fell into the water around 12:45 p.m. It was immediately evacuated and will remain closed indefinitely. Some of the wharf’s pilings are still in the ocean and remain “serious, serious hazards” to boats, the mayor said. U.S. Bankruptcy Judge Christopher Lopez in Houston said he did not want another auction but offered no roadmap over how to proceed. One possibility includes ultimately allowing Sandy Hook families — who comprise most of Jones' creditors — to return to state courts in Connecticut and Texas to collect on the nearly $1.5 billion in defamation and emotional distress lawsuit judgments that Jones was ordered to pay them. “Our hope is that when this process ends, and it will end, and it will end sooner rather than later, is that all assets that Alex Jones has available are paid to the families, and that includes Infowars, and that as a result of that process Alex Jones is deprived of the ownership and control of the platform that he’s used to hurt so many people,” Christopher Mattei, an attorney for the Sandy Hook families, said in a phone interview Wednesday. The families, meanwhile, were preparing the mark the 12th anniversary of the Dec. 14 shooting. Why was The Onion bid rejected? The sale of Infowars is part of Jones’ personal bankruptcy case , which he filed in late 2022 after he was ordered to pay the $1.5 billion. Jones was sued for repeatedly saying on his show that the 2012 massacre of 20 first graders and six educators was staged by crisis actors to spur more gun control. Lopez said there was a lack of transparency in the bidding process and too much confusion about The Onion's bid. He also said the amount of money offered in the only two bids was too low and there needed to be more effort to try to raise as much money possible from the selling of Infowars' assets. The Onion's parent company, Global Tetrahedron, submitted a $1.75 million cash offer with plans to kick Jones out and relaunch Infowars in January as a parody . The bid also included a deal with many of the Sandy Hook families for them to forgo $750,000 of their auction proceeds and give it to other creditors. Lopez called it a complex arrangement that led to different interpretations of the bid's actual value as well as last-minute changes to a proposed sale order. The other bidder was First United American Companies, which runs a website in Jones’ name that sells nutritional supplements and planned to let Jones stay on the Infowars platforms. It offered $3.5 million in cash and later, with Jones, alleged fraud and collusion in the bidding process. Lopez rejected the allegations, saying that while mistakes were made there was no wrongdoing. Christopher Murray, the trustee who oversaw the auction, said he picked The Onion and its deal with the Sandy Hook families because it would have provided more money to Jones' other creditors. What happens next? The next steps remained unclear Wednesday. The judge directed Murray to come up with a new plan to move forward. Murray and representatives of The Onion did not immediately return messages seeking comment. The judge said there was a possibility there could be a trial in 2025 to settle Jones' bankruptcy. He said Murray could try to sell the equity in Infowars' parent company. He also said Murray could abandon the efforts, which could allow the Sandy Hook families to return to the state courts where they won their lawsuits against Jones and begin collection proceedings against him. The federal government's proposed social media ban for under-16s has been unveiled in the parliament, with $50m in fines for big tech companies which don't comply – and an admission from Labor the new rules may require all Australians to hand over more of their personal data. But while the government has promised "robust" privacy protections for that extra information, and bans on social media giants using that data for other purposes, we still don't know exactly what kind of data people will have to hand over. The government instead is kicking that can to the big tech firms themselves, essentially asking Facebook, Snapchat and X to come up with their own systems instead. Here's what we know so far – and what questions still need to be answered. Which platforms will be targeted? The communications minister, Michelle Rowland, introduced the legislation on Thursday. She said the laws aren't meant to apply to messaging services, such as Facebook Messenger or WhatsApp, or online services like Kids Helpline. The laws will also give some exemptions to products used for educational purposes, such as YouTube or Google Classroom. The bill is introducing a new term – "age-restricted social media platforms" – into the Online Safety Act. This will apply to platforms such as TikTok, Facebook, Snapchat, Instagram and X, Rowland said – as well as message board Reddit. Specifically, the bill seeks to stop under-16s being "logged in" or having accounts on those services. Young people would still be able to view YouTube videos while being logged out of the platform, or view some Facebook pages used for a business in a logged-out state. On top of the laundry list of accused misconduct on the set of the film “ It Ends with Us ,” Lively’s surprise weekend filing against her director and costar Baldoni lays bare a show business process that’s meant to operate in the shadows – the hiring of expensive crisis communications experts to sway opinion and uplift clients. Attorneys for Lively obtained numerous text messages between Baldoni’s personal rep Jennifer Abel and the crisis team he retained this summer, led by Melissa Nathan. Documents and texts said Baldoni did so to prepare for a scenario where Lively would come forward with accusations from the set, as well as narratives that key cast members were distancing themselves from Baldoni during the promotion of the Sony Pictures release. The exchanges reveal candid – or “cringeworthy,” as one competing crisis expert told Variety – efforts to counter Lively by enlisting friendly journalists and allegedly hiring a digital whiz to fabricate and amplify unflattering content about her. Baldoni’s attorney Bryan Freedman blasted the claims and supporting documents, like text messages and a multi-page strategy, as “cherry-picked” to build a narrative that forgoes crucial context and, in what would be important for Baldoni in this case, inaction in coming after Lively. While the complaint is under investigation by Freedman, the attorney said he is confident the full picture will reveal “nothing untoward happened” when it comes to Lively and Baldoni’s team — and that “reputation management,” as its commonly referred to in the digital lives of celebrities, is routine for countless public personalities. This weekend, Abel addressed the Lively complaint in a private Facebook group for PR and marketing professionals. The post, verified by Variety , said that texts and documents obtained did not intend to smear the actress. “No negative press was ever facilitated, no social combat plan, although we were prepared for it, as it’s our job to be ready for any scenario, but we didn’t have to implement anything, because the internet was doing the work for us,” Abel wrote. In a statement, Freedman added that Nathan “operated as any other crisis management firm would when hired by a client experiencing threats by two extremely powerful people with unlimited resources,” referring to Lively and her husband Ryan Reynolds. “The standard scenario planning TAG PR drafted proved unnecessary as audiences found Lively’s own actions, interviews and marketing during the promotional tour distasteful, and responded organically to that which the media themselves picked up on.” Some power players were dismayed by the tough tactics being floated by Abel and Nathan to “smear” Lively. Nathan pitched a four-month battle plan with a $175,000 price tag to “start threads of theories” on platforms like Reddit and TikTok in Baldoni’s favor, and to create “social fan engagement to go back and forth with any negative accounts, helping to change [sic] narrative and stay on track,” Lively’s complaint said. There was also the contracting of Jed Wallace, operator of a firm called Street Relations. One source described him as a “Ray Donovan” type fixer employed by powerful people. Freedman, who knows Wallace well, said he would not describe him as a fixer but rather someone with deep resources for unusual circumstances (he knows how to get a chopper for medical evacuation in remote parts of Italy, for instance). Lively’s complaint filed with the California Civil Rights Department said Wallace weaponized “a digital army around the country from New York to Los Angeles to create, seed, and promote content that appeared to be authentic.” While the suit does not specify which stories might have targeted Lively, numerous unflattering pieces about the actress were resurfaced during the press tour for “It Ends with Us.” They included problematic past comments about the trans community (using the phrase “trannies”), and an attempted lifestyle brand launch in which Lively promoted the “allure” of an Antebellum South aesthetic . Most importantly, Nathan stressed in early days, these efforts would be “untraceable.” Not anymore. “It’s quite common for crisis people to be reactive, to monitor and respond to situations,” said one veteran media broker who has hired crisis firms on behalf of clients. “But to stage this entire campaign? To put this in writing?” The source added that “fix-it shops usually employ some cyber warriors who come in to manage chatter, but it’s an unwritten code that you will not hire companies or social media agitators to go out and script a new narrative.” Crisis PR is common in many sectors for individuals, corporations and political parties. What has industry insiders aghast over this conflict is the nature of the correspondence. “You know we can bury anyone,” Nathan wrote to Abel in a February text cited in the complaint, ironically in an exchange about how she could not put such things in writing to Baldoni. In an early Monday statement, Freedman said it was “ironic that the New York Times, through their effort to ‘uncover’ an insidious PR effort, played directly into the hands of Lively’s own dubious PR tactics by publishing leaked personal text exchanges that lack critical context – the very same tactics she’s accusing the firm of implementing.” Some PR pros were empathetic to Abel and Nathan, given the unusual disclosure of private texts and documents which were likely subject to nondisclosure agreements. “There are two smear campaigns going on here,” said one top studio executive. “One against Lively, and one against the PR people.
